TERMS AND CONDITIONS
FOR RESIDENTIAL FENCING SERVICES
ARTICLE 1: INTRODUCTION
These Terms and Conditions delineate the mutual obligations and agreements between Alamo Labor Pro LLC (hereafter referred to as “the Contractor”) and the property manager (hereafter referred to as “the Client”) concerning residential fencing services.
ARTICLE 2: PROJECT SCOPE AND EXECUTION
2.1 The Contractor shall provide fencing services as detailed in the preliminary assessment and proposal, employing materials of high quality and adhering to professional standards.
2.2 Any changes to the agreed-upon project scope shall be formalized through a Change Order, including details on additional costs and adjustments to the project timeline.
ARTICLE 3: SCHEDULING AND TIMELINESS
3.1 The Contractor commits to adhering to the agreed start and completion dates, subject to change due to unforeseen circumstances such as inclement weather or material availability.
3.2 In case of delays, the Contractor shall inform the Client promptly and collaborate to revise the project schedule as needed.
ARTICLE 4: FINANCIAL TERMS
4.1 Payment obligations are to be fulfilled in accordance with the predetermined schedule, commencing with an initial deposit and culminating with the final payment upon project completion.
4.2 Delayed payments are subject to the accrual of interest charges.
ARTICLE 5: PROPERTY SAFETY AND RESPONSIBILITY
5.1 The Client is advised to take steps to protect personal property and indoor areas from potential damage during fencing operations.
5.2 The Contractor will maintain comprehensive insurance, including liability and workers' compensation, throughout the project.
ARTICLE 6: WARRANTY AND QUALITY ASSURANCE
6.1 The Contractor’s fencing services come with a warranty, covering installation and material defects for a specified period post-completion.
6.2 The warranty does not cover damages caused by external factors beyond the Contractor's control, such as extreme weather or unauthorized alterations to the fence.
ARTICLE 7: SPECIAL CONDITIONS
7.1 Boundary and Property Lines:
The Client is responsible for confirming property lines and ensuring that the planned fence does not encroach on neighboring properties.
Disputes arising from boundary issues are not the responsibility of the Contractor.
7.2 Local Regulations and Permits:
The Client must ensure compliance with local zoning laws, homeowner association rules, and obtain necessary permits.
The Contractor may assist in this process but ultimate responsibility lies with the Client.
7.3 Underground Utilities:
Prior to digging, it is essential to identify and mark underground utilities. The Client should coordinate with local utility companies for this purpose.
The Contractor is not liable for damage to unmarked utilities.
7.4 Environmental Factors:
The Client acknowledges potential impacts of local wildlife, soil conditions, and vegetation on the fencing project.
Any adjustments due to these factors will be discussed and may incur additional costs.
7.5 Access and Clearance:
The Client must provide clear access to the work area for the duration of the project.
Obstructions or limited access causing delays may result in additional charges.
7.6 Maintenance and Upkeep:
Post-installation, the responsibility for regular maintenance and upkeep of the fence falls to the Client.
Neglecting proper maintenance may void certain aspects of the warranty.
ARTICLE 8: CANCELLATION AND TERMINATION
8.1 Either party may dissolve the contract in the instance of a significant breach, subject to the provision of advance written notice.
8.2 Should the Client elect to cancel the service subsequent to a specified duration from the agreement date, a cancellation fee may be imposed.
ARTICLE 9: GENERAL PROVISIONS
9.1 This agreement is governed by the laws of San Antonio, TX.
9.2 The resolution of any disputes through mediation is to be prioritized by both parties, and if necessary, may proceed to binding arbitration.
